My aunt passed away recently and my cousin is the executor of her will, and I am listed in it. I live in California however my aunt and here estate is in Missisppi. I just want to know how long does it normally take for property to go thourgh probate and chancery court. My cousin won't tell my anything except that he has just got the paperwork together to give to the lawyer, he intially went to see the lawyer just a few days after the passing. How long does the entire process usually lasts.....

Re: time period from the time of death until estate is settled

There is no set time for the administration of an estate, except that it will take longer than 90 days. Mississippi law provides that creditors have 90 days, from the date that notice to them is first published, to file their claims against the estate. I tell my clients that if the estate presents no complications, no claims from creditors, no fighting heirs, and the attorney does everything as fast as possible, the estate can be closed in less than 150 days. However, 6 to 9 months is not abnormal.

It will take at least 90 days after the papers are filed with the court. That is if everthing comes together just right, everybody gives the matter top priority, and there are no issues.
