Legal Question in Wills and Trusts in Mississippi

Widow's rights to real estate of deceased husband

When my stepfather died he did not leave a will. Did my mother become the owner of the property (real estate) even though her name was not on the deed? They were married and living together over fifteen years when he died in 1950. At her death, will the stepchildren get equal shares of the property?

Re: Widow's rights to real estate of deceased husband

Despite the fact that your mother's name

is not on the deed, your mother is entitled

to what is known as a "widow's portion" of

your deceased step-father's estate, the

"widow's portion" not being more than 1/2 and

not less than 1/3, depending upon the number

of natural children your stepfather had.
