Here is a brief outline. The will is filed with the Chancery Court Clerk for the county in which the decedent last lived along with a petition for probate. Letters of administration are issued to the executor by the clerk. A notice is published in the newspaper for creditors to submit claims. The Executor takes control of all the assets and reports to the court all the claims and assets. The Court orders payment to qualified creditors, distribution of the remainder according to the terms of the will, and that the estate will be closed upon the distribution. The Executor then makes distribution according to the will.
