Legal Question in Wills and Trusts in Mississippi

Wills, Probates, Social Security Law

My grandfather passed away a few years ago and I found this out myself. I did not know him because my grandmother tried to keep me away from the family. Do I recieve social security benefits from him if my parents are divorced? How do I search to see if my grandfather left estate or assets for me? I do not know anything about his will, probates, assets, nor estate...what should I do...I feel like my grandmother is hiding something from me.

If your grandfather left anything for you, you probably would have been contacted. However, if you wish to make sure, you need to go to the Chancery Clerk's Office in the Courthouse in the County where he lived and the County where he died to see if his estate was probated. Please note that some Countys have two Courthouses. You can also check to see if he owned any land by looking in the records of the Chancery Clerk. Ask them for help and they will probably help you.

someone else will have to tell you about social security, but you could call your nearest Social Security Office to see.

If your grandfather died without a will, your grandmother and his children would share in his estate. If his child who is your parent predeceased your grandfather, you would be entitled to inherit a share of whatever your parent would have inherited.

If your grandfather left a will, it is very likely he left everything to your grandmother. If your grandfather's estate has not been administered by the Court already, you can petition the court to have it administered.
