medical bills due to head injury
I drove under a pickup truck. Bumper sensors for my airbag did not engage until after I hit my head. My short term memory has been wiped out and I suffer from severe headaches. The driver at faults auto insurance has a 25k max on injury. My medical bills and other damages far exceed his insurance coverage. Is my only recourse to sue him he is 21? He has auto insurance and he was driving his fathers truck which also has coverage. Shouldn't I be entitled to both policies. His since he was the driver and his fathers since he owned the vehicle? Help I've gone thru so much and I can't afford the speech and memory therapy that is supposed to help me

My sympathies for your injury. This accident should not wreck your future! As a victim of negligence you deserve to be restored to the condition and life you enjoyed before you were wronged. Insurance companies are notorious for being tight-fisted and often their idea of making the injured whole is far less than what is deserved or needed. Experienced counsel is essential when doing battle with an insurance company. In your case you can expect to involve two, possibly three (or more!) insurance policies. The most important thing right now is receiving treatment and assessing your damages. Often accident victims that feel well today have complications down the road. First I would like to say that I'm sorry that you have been so seriously injured. I hope that you can get all of the treatment you need to enjoy a full recovery. Next, it would be helpful to know more about your situation. Where do you reside? Where did the collision occur? Where does the other driver and his father reside? To respond generally to your questions, I would say that it is possible that two or more insurance coverages may be "stacked" so that you may be able to recover more than $25,000 in damages. It may also be possible that your own "med pay", and "under-insured motorist" insurance may provide a source of funds. If the other driver was employed and operating within the course of his employment, there may be an employer or an employer's insurance carrier to deal with also.
