Legal Question in Family Law in Missouri

My wife moved 200 miles away and said she wanted a divorce. I still live in the family home and I filed for divorce and my wife contested everything on it. I am asking for joint legal custody and full legal custody because the schools are better where I live. My lawyer seems unsure of what to do. Shouldn't he request a court date so the judge can decide where our child goes to school?

Custody factors are set out in the statutes and school district is only one of the many considerations. Either you and your wife can agree on custody or if you cannot agree you can have a hearing to determine temporary custody until your case is over or determine custody at trial. If you have an attorney you should speak with them about the matter.
