Legal Question in Appeals and Writs in Missouri

driving while revoked

My license was revoked for one year on October 22, 2004. May 13, 2005 I was involved in a non- injury car accident. It was the other drivers fault (it says so in the police report). I was in the parking lot of my apartment complex moving my car and the other driver was on the public street turning into the complex. The police arrived and they could not arrest me because I was on private property. I received a ticket for driving while revoked along with a court date. Now the judge has sentenced me to one year S.E.S. unsupervised probation and twenty five hours of community service. Can they really do anything about it since I was on private property? If so, I need help.

Re: driving while revoked

Yes.

You were operating a motor vehicle.

You operate that vehicle by turning the ignition key. If you do not have a valid license, you can be cited.

A one year SES seems like a very good deal to me under the circumstances, but if you are concerned about this, you should see an attorney specializing in traffic law and have your case evaluated.
