Legal Question in Banking Law in Missouri
Dad's Checking Account
My dad recently passed away. Prior to his death his wife of two and a half years went to the bank and wrote her name on his bank account without his knowledge of it. He at the time was incoherent dying of cancer. He was sole owner of the account. His will stated that my brother and I were beneficiries of his estate. The document that I saw at the bank had his name typed and hers hand written in beside his. She withdrew the money and divided it among her kids. Can the bank legally allow her to do this? Is this a legal document?

Re: Dad's Checking Account
Need to see his WILL before I could advise you. Spouses usually have priority, esp if an account is set up as JOINT or PAYABLE ON DEATH.
She may have had a POA, also.
