Legal Question in Bankruptcy in Missouri
I am currently in a Chapter 13 have been for almost 3 years. I would like to file a motion to sell my home. Do I have to use the original attorney that filed my Bankruptcy case or can I hire someone else?
Thanks
Dan

Dan--
You can always hire a different attorney. I don't know how the fee structure has been set up. If the original attorney has been paid to do additional work--such as filing a Motion to Sell the house--then this will create complications. If you are in a 36 month plan and it's about done, then your best option may be to wait. If you are in a 60 month plan, the original attorney will need to be discharged and the new attorney will need to enter his/her appearance.
