Legal Question in Bankruptcy in Missouri

I need to know if filing bankruptcy would get rid of credit card debt that I am unable to pay. These debts were a result of me trusting a sister and her son in a business deal. A couple credit card companys have already obtained judgements on me and now have liens on my house. 2 others have sold my acct to debt collectors who harass me alot. Would bankruptcy eliminate the judgements and liens also. Please advise me what Chapter I would need to file if necessary, and would I be able to keep my house. I am current on house pmts. I do have a car but it isnt worth much.

Sincerely, Struggling in Missouri to get by.

The short answer is almost certainly yes. I'm assuming that although the debt arose as a result of business dealings, the debt itself would fit the criteria for a "consumer" debt. If there are liens on the house, there is a bit more work to be done to get rid of them, so be prepared to pay a little extra for your bankruptcy. What chapter you should file depends upon how much income you have and how much property you own, and what type. As a general rule, people with less income and less property are better candidates for Chapter 7. You can keep up to $15k of equity (that's the value of the house minus what you owe) in a Chapter 7. Many bankruptcy attorneys give free consultations. You have nothing to lose by getting more information that would apply specifically to your situation. Good luck.
