Legal Question in Bankruptcy in Missouri

Hello,

I filed for bankruptcy in 2006 a chapter 7, at that time I was single, I'm now married and me and my spouse would like to file for Bankrutcy( chapter 7) he has debt and sad to say so do I again, Can I file again? Or do we have to file separately?

Hello----Sorry, but you will have to wait a while to file. My notes on this say that 8 years must elapse between one chapter 7 and the next. A chapter 13 may be filed 4 years after a chapter 7, so that would bring you to 2010, and we're almost there. Your spouse can file on his separate debts; contrary to belief, marriage does not automatically make one responsible for the debts of his/her mate. It might be best if you did not have joint credit cards or other joint obligations.
