Legal Question in Bankruptcy in Missouri
my husband filled chapter 13 6 months ago. I sold some property thats in my name only and i will receive a 20,000 dollar payment. how can i be sure that bankruptcy court or creditors wont attach the $20,000?

This answer is based on the assumption that the property "in your name only" truly is your separate property--perhaps from an inheritance?--and isn't really disguised joint property. Place the funds in a separate bank account that has your name only -- not your husband's. Actually, if only one of you has filed, you should be keeping your financial transactions as separate as possible, so that the reality of your husband's expenses pretty well matches the Means Test and Schedule J on his petition.
