Legal Question in Bankruptcy in Missouri
Length between filings
I am wanting to file for Chapter 7. I just completed a Chapter 13 in which most bills were paid 70% of what was owed and in some circumstances 100%. Can I file a chapter 7 now? The 13 was filed when I was still married and this was done in 1994. I really need to know if I can file anything as soon as possible! The 13 has been discharged as of October of 1998. Please let me know just as soon as possible. I have an appointment with an attorney in my town next week but I can't talk to him until then. Thank you!

Re: Length between filings
Why would you want to file a 7 after completing a 13? You should have next to no debt.
In any event, you can "file" a 7 now, but you can't get a Ch. 7 discharge in a case filed w/in 6 years of the filing of the former case, unless you paid all creditors 100% or at least 70% and the plan was your best effort.
But, again, unless you incurred medical bills after your 13 discharge or the like, I can't see why you would want to file a 7 now.
