Legal Question in Bankruptcy in Missouri

What is the length required between 1st and 2nd filing?

We filed bankruptcy in August 1991, and it was discharged in December 1991. We are desperate to file again (doctor bills totalling thousands of dollars, etc.) How long do we have to wait to file again and what are the new laws regarding how long a bankruptcy stains/tarnishes your record. Our credit is "jacked" anyway....this won't make it any worse, guarantee it! We have approximately 2,000 in assets and 40,000 in debt.

Six year rule should apply

The rule is that a debtor is nto entitled to a discharge if that debtor was granted a discharge in acase commenced within six years before the date of this filing. According to the facts you provided and the rule, you would be elgible for another discharge if you complied with all the rest of the rules as you would do in any case.

If we have not met face to face and agreed to my representation of you in a written agreement signed by both you and I, then I am not your lawyer. Any comments made here are not legal advice but presented in the spirit of this bulletin board as general information only.
