Legal Question in Bankruptcy in Missouri

Re-Location fees given to me by the state...

I'm 3 yrs. into a Chapt. 13, payments are current and have been. I owe $13,000 left in the plan. We are being re-located due to the State buying the house that we're leasing. The State is going to give us $37,464 earmarked for down payment and closing + $1400 moving exp. Will the courts ask for this money when we go before them for a stay to buy a house?

Re: Re-Location fees given to me by the state...

The trustee/court may well require a plan modification that would increase the total amount you are required to pay, unless you use the proceeds to satisfy the plan in a lump sum. This all varies a lot among the judges and trustees around the country, so consult with your bankruptcy lawyer.
