Legal Question in Business Law in Missouri

The builder knew

We bought oour house in 1998 and we picked it out when there wasn't sheetrock up, now we are in the process of trying to sell it and we have discovered that the builder didn't set up the crawl space right we have standing water and only a partial vapor barrier and we are looling at quite an expense to fix it correctly, which we have to do before we can sell our home, which I wouldn't want anyoone else to have to do it. Is there any kind of recourse that we could have against the builder, because when we looked at it the first time we knew the water was there and they installed a sump pump and said that when the yard grew in that it woouldn't run anymore, but we still have it running. I feel like they put a bandaid over it instead of fixing it right.

Re: The builder knew

I suggest you talk to your builder and ask them to repair the problem. Unfortunately, since it has been 5 years since the house was built, the builder may not be willing to make the repairs with just a phone call. Instead the builder will likely ask you why the problem wasn't reported to it sooner. If the problem in the crawlspace is that the builder did not grade the land properly to prevent water from pooling under the house, then you might have a valid claim against the builder. It depends on the specific facts of your case and whether other reasonable builders would have done something more than what was done by your builder at the time the house was built. If you don't feel comfortable dealing with the builder personally, I suggest you hire an attorney to assist you with the matter. The attorney can determine what liability exists and you'll certainly have more leverage with an attorney involved. Good luck. If you would like further assistance, do not hesitate to call.
