Legal Question in Business Law in Missouri
I have a cleaning business and have a signed contract with a company that will end on Dec. 31, 2011. I have heard through the grape vine that the company may tell me that don't want me to clean anymore due to them being short on money. I have not gotten on complaint in the 2 years I have cleaned. How binding is my contract? I heard that the only way they can get out of the contract is if my work is not good or if they file bankruptcy. Is that true?
1 Answer from Attorneys
As a Franchise Attorney familiar with contracts, I can say the following. It's impossible to tell how binding your contract is with examining it. Hopefully it was drafted by an attorney. That said, anyone can discharge a debt (like a contract) in bankruptcy. Other than that, if you do basically what you're supposed to do, and stay out of breach, the other party has to perform its contractual obligations. It is a good idea to consult with a good business or franchise attorney in your area to review (and fine-tune) your existing contract and for specific advice.
