Legal Question in Business Law in Missouri
''collecting of debt''
After a brief business relation with a sub-contractor, who did job estimating for my painting co. I foundout he had picked up some checks belonging to my co.
Recently I recieved a check in the mail to my co. instead of his for work he had done
Can I deposit this check in way of collecting what is owed to me?

Re: ''collecting of debt''
The old saying is "two wrongs don't make a right." His actions were criminal, and you can also sue in civil court to get back the money which he stole if he fraudulently cashed checks made payable to your company.
While you may wish to cash checks made payable to him, and you may be owed money, you commit a crime if you fraudulently endorse checks made payable to him. Unless I misunderstood your question, that is what you were contemplating, and it will cause you trouble! Better to sue him, and report him to the prosecutor as well than to get yourself into a tangle.
