Legal Question in Business Law in Missouri
if a company is disolved by the state for non payment of employment taxes does that make a non compeat clause null and void ?

Any business or franchise attorney will say companies are not dissolved for nonpayment of taxes. The state my have suspended their corporate charter, but this does not impact the validity of a non compete. It may be a legal ground to challenge its enforceability until the company reinstates itself. Consult with a good business or franchise attorney in your area for specific advice.
