missouri law on llc partnerships or dba's
It was suggested that my dba be an llc company with just
my wife and myself. Just in process of setting things up/

Many times an LLC is a better entity in which to do business than a sole proprietorship or partnership; however this is not always the case. There are various legal distinctions between the entities as well as significant tax considerations that you should consider before making the decision. I would highly recommend that you consult with an experienced business attorney prior to making this decision as failure to do so may open you up to even more liability down the road. The limited liability of an LLC is a wonderful advantage of the entity; however, if you do not follow certain legal requirements your actions can negate the limited liability. Many attorneys handle formation of an LLC or other business entities for a flat fee of $500-$1000. This will be money well spent if you wish for your business to be successful and will provide you with the knowledge you need to run your business entity in accordance with the law. Cutting corners by trying to save a few bucks on legal fees at the outset can land you in hot water down the road.
