Legal Question in Business Law in Missouri

On November 2 my husband paid in advance (with a check) for a December 14 wedding reception for my son and his fianc� (they reside in Ohio, but wish to get married in Missouri so their grandparents are able to attend). Later that day my husband and father were victims in an armed robbery in the area and my husband was shot (not fatally). On November 19, once my husband was home and recovering and things began to settle down, we contacted the venue to cancel the reception (we tried to contact them a few days earlier, but there was no answer.) The venue owner refuses to cancel and/or issue a refund, stating that they have already used the money to pay their outstanding bills, and further that they require 60 days notice of cancellation. The venue was never contacted, nor a contract signed before November 2 and no language or terms regarding cancellation were amended in the contract. My son and his fianc� are planning a simple wedding ceremony and then plan to spend the time after in our home with family. My question is - how do we obtain a refund, or at least a partial refund, allowing the venue owner to keep a small fee for their time?
