Photographs taken on Company time.
An employee took photographs of a company incident on a disposable camera given to them. After the situation the employee said they did not have to relenquish the pictures due to personal reasons. The employee would not have had access to the incident except that he was at work on company time. Is the company within the law to demand the return of the pictures?

Re: Photographs taken on Company time.
Under the facts as you have stated them the company owns the camera, the film (if any) and the images. A work produced by an employee while on company time and within the scope and course of his duties as an employee is a "work for hire" under the copyright law and the company, not the individual, owns the copyright. The employee can be compelled to return the images to the company by court order if necessary.
