Restaurant Purchase

I was in the process of purchasing a restaurant, then decided against it. Now the owners are taking me to court saying I am in breach of contract and have to buy the restaurant. My loan was not approved, I have no money to go thru with the purchase. The agreement that was written up was for the purpose of obtaining the loan and it was asked for by the bank. I have 3 weeks to take documents to court in Clay County, MO. What should I do?

It is impossible to predict your chances of winning at court, just by a hsort description of yrou situation. It does apper that you need legal counsel and you need it fast. Have an attorney look at the documents that were created in the almost purchase and compare them to what is alleged in the restaurant owner's petition. Do not delay, it may hurt your defense of the lawsuit.

I would recommend that you retain an experienced civil defense attorney to represent you. Otherwise, you could be facing a default judgment. The civil defense attorney will help you by drafting an answer to the petition against you. Depending on how the petition is drafted and the particular facts involved, you may be able to obtain a dismissal by filing a Motion to Dismiss.
