Legal Question in Civil Rights Law in Missouri
I just got a summons today for an automobile accident I was in back in October 2008. No one was hurt . I did hit someone in the back of their car, however nobody went to the hospital and they drove off in their car (the bumber on their car had to be replaced and no air bags deployed). In July of 2010 I recieved a letter from my insurance company telling me that the parties involved are now suing for 75,000 in damages claiming that they have neck, back, and shoulder injuries. My coverage with the insurance company is only $50,000. When I got the summons today I called the insurance company to see if the case had been settled and it has not ( no pay off has been rendered), so why am I recieiving a sumons for a Civil Case for me to pay $25,000 when they have not recieived anything from my insurance company yet?

The law suit is against you, not your insurer. You need to file and answer in time, or a judgment may be renderend against you by default. Most insurance policies include a provison wherein the insurer (your insurance company) supplies defense counsel for the insured (you). Make sure your insurer knows that you have been sued, in what court, and when the answer date is. Otherwise they may deny coverage because you failed to cooperate.
