Legal Question in Construction Law in Missouri
I hired a contractor to put a new roof on, paint the house and put in 4 new windows. First day, the front of the house was done as far as the roof and they started on the back, but a storm was rolling in so they quit. But did not bother to put any kind of heavy tarp on my roof. During the night I had water damage inside my house, (kitchen, bathroom, bedroom, attic and dinning). I have not heard or seen him since June 27th. My home owners insurance denied the claim and so I am stuck with mold growing in my house. I did have a contractor come out and he stated it will be about $26,000.00 to fix my house. Plus he did not even finish the job. The over hang over the front porch is not done and the part that is done is done wrong. Please help me on what direction I need to take.

There are two potential ways to recover for this loss. First, you may in fact have a viable claim against your homeowners insurance company. I would need to read the policy in order to give you advice on this. Just because they deny the claim does not mean there is no coverage. Often, companies will initially deny the claim or deny the claim under a reservation of rights when there is coverage available. I have helped many people overcome insurance claim denials.
Second, there are several claims available against the contractor and the contractors insurers if any. The trick on a claim against the contractor is to prevail in a way that will lead to payment, not just a judgment.
