Can an additional requirement stated by email be added to our
refund Contract that we have to sign in front of a notary ? Should we reference it along with our signatures ?

Generally once a contract is formed, neither party can alter the terms without the consent of the other. Some agreements include a clause wherein the parties agree that one party of the outer can change some terms with notice to the other. Absent the prior agreement, the new refund term is an offer to change the agreement. The other pay w can accept the new term, or enforce the original term. As for strategy as to how to document greed agreement as to the new term, it is dependent upon several criteria. Discuss your specific needs directly with the aircraft drafting the contract for you.
