Legal Question in Consumer Law in Missouri

Cellphone contract

I have a contract with a cellphone company that expired in July 2005. This contract includes 2 phones and equipment failure for those phones. My daughter's phone stopped working in January 2005 so she took it in and they told her it would be 50.00 deductible for a phone like hers, but they would cancel out the contract and she could get a better phone for the same price. They renewed the contract for 2 years beginning July 2005, without contacting me. My name is the only one on the contract. I didn't know anything about this until I went in to get a new phone and found out I was still under a contract that had began in July 2005. Is this legal?

Re: Cellphone contract

If your daughter was under 18 at the time she signed the contract it is not valid. Even if she was over 18, if the account was in your name, then you are not bound. Your daughter might be, but you should not be.
