Legal Question in Consumer Law in Missouri
Installment contract
A local company replaced an HVAC unit at my residence. I asked the technicians to leave after I caught them hitting the coil with a hammer. I complained to their office manager that they refused to leave. He told me he would have someone come out and look at it. After 3 hours of fighting with them, they finally called the technicians and told them to leave my house.
I had signed the installment sales contract prior to the work being done and the technician put the paperwork in an envolope and took it out to his service vehicle.
They did not finish the installation. They did not answer my calls.
Three months went by and just yesterday, the salesperson came to my home and said I would have to sign another loan document because they could not find the original.
I told them I had to talk to a lawyer before I was going to deal with them again. ( I felt like telling him to go jump in the lake).
What should I do?
I placed several calls to the original company with complaints and no one ever called me back.

It appears that you may have a good negotiating position. Obviously you are not going to get a free HVAC unit. But, you may be able to have your attorney work a better deal than you originally signed on your own. Until you choose an attorney, Do Not sign any new deals with the company.
