Legal Question in Consumer Law in Missouri

Paying for something and not receiving it.

I won a bid on ebay and sent a personal check. I have never received the merchandise and very little replies from my attempted contact. They have my money and I don't have any merchandise. I also received a number of emails from other people whom they had ripped off. I sent money in Oct 2004. They promised delivery by 12/31/04. Only other correspondence has been to stall for time. I have bought another set by now and just want my money back. What can I do to get my money back.

Certianly you should lodge a complaint through ebay, but they won't do much for you. If you can determine who the seller is, then you may be able to sue to get the money back. Do you have the cancelled check? The many emails you said you got form others that were supposedly ripped off, may be part of teh seller's scheme to dissuade you from pursuing him for your refund.
