Legal Question in Consumer Law in Missouri

product return

My 16 year old son was approached by sales lady at the mall for face cleansing products, was put through the pressure sales pitch. She took his credit card from his hand and swiped it without checking his ID or checking the back for an authorized signature(has no signature)$190.00.They have an approx. 3'' sign posted on a the stand of ''no returns or exchange''. He realized minutes later what had happened and tried to return the products and was then informed of the no return policy. Have I any legal way to return these products for a refund? He presented this to me very upset and of course I was also.

Re: product return

First tell the credit card company that you refuse the charge, and ask them to reverse the charge. Call the manager of the store and tell them that as 16 year old, your son has the right to rescind the deal. if he does to immediately agree to accept the refund, get the name of the manager and the lady who swiped his card, and make a police report for fraud and theft by deception. Call the local TV station or newspaper and ask them to investigate the bad sales practices. You may also need to make a report with the state attorney General (Jay Nixon) office. This sounds like the type of prectices that they try to stop. They will nto act in yrou individula behalf, but they may investigate to see if this is a one time occurrence or trend.

You should be able to get the money back, or the credit card charges removed. But, it wil probably take some leg work. The work may bery valuable in teaching your son how to handle his money and resolve situatios where he gets tricked or rippped off. The time and effort yoru spend might be more than the $190.00 you are out, but the future value to your Son may be much greater.

Good Luck
