Legal Question in Consumer Law in Missouri
Purchased a couch from a local furniture company. Paid for it in full. Receipt states "Paid in full". 9 months later, the furniture company sends a certified letter that we still owe a balance. Called and explained that we paid in full. Bookkeeper of furniture company says they forgot to charge us sales tax and and delivery fee. Balance owed is about $350. We were not aware that they "forgot sales tax and delivery fee". Confused, I tried to reason in person, but manager was adamant that he had the right to discover their mistake and charge me 9 months later. Furniture company says they will send to collections. What should I do? Live in state of MO.
1 Answer from Attorneys
Based upon the facts you described, you probably do not owe any delivery fee. But, you might owe sales tax. You should consult directly with a civil practice attorney, in your area, to examine th reciept and letter, before you decide what to do.
