Legal Question in Consumer Law in Missouri

repossesion of vehicle-retrieving property in vehicle

I had a vehicle repo'd approx 2 weeks ago. I contacted the finance manager to get name and phone number of towing service so I could make arrangements to retrieve my personal belongings. I left a message for a return call but never rec'd one. I again contacted the finance manager to get the phone number again but have yet to receive a phone call and I have since lost the phone number of the towing facility. Is there anything I can do at this point?

Re: repossesion of vehicle-retrieving property in vehicle

Call the finance manager and tell him you want the personal property delivered to you right away. If he balks tell him that your next call will be to law enforcement to file a claim for theft. They hold title to the car, but not to your personal property. In most cases this will work.

Your other option is to sue for conversion in small claims court (assuming the value of the property is less than $3,000). This, however, opens you up to a counterclaim for any deficiency on the vehicle, so you'd have to be careful about that.
