Legal Question in Consumer Law in Missouri
Can Walgreen's keep a difference in an amount of a purchased product? The original price on the medication was $33.08 and had to be returned. The new medication was $18.99. The difference is $14.09. Can they just keep that because of an error on the script written by the Dr.?

Your is a dificult question to answer. Under the facts you described, it may be the doctor that owes the difference to you. If the doctor wrote the wrong script, and the pharmacy fille dit as written, then they did not cause you to have the extra cost. It appers that they were gracious in giving you credit for the return of the medicine. As you describe the situation, they were nto required to credit you anything, as they may not be allowed to redistribute the previous medicine to another customer.
If the pharmacy filled the wrong prescription, than you or your insurer are entitled to a refund of the difference.
