Legal Question in Credit and Debt Law in Missouri

AC Breach of Contract

I have been served with papers re: ac breach of contract, relating to an educational stipend I received in nursing school. I'm wondering if the court offers arrangements for repayment, or if a garnishment is pretty much the standard judgement. I cannot repay the balance ($3100), but also cannot afford 25% of my wages to be garnished.

Re: AC Breach of Contract

First of all, the court does not offer to make any arrangements. If you don't show up for court, or if you sign a Consent Judgment, or if you go to trial and lose, the court will simply enter a judgment for the amount of money owed or agreed to by you and the creditor. Then, the creditor can file it's garnishment. I would strongly suggest that you consider hiring an attorney. For a relatively modest fee, the attorney should be able to negotiate with the creditor's attorney to save you some money and to settle the case with payment arrangements that you can actually perform. In some cases it is also possible to obtain better results, Do not go through this without an attorney representing you. Good luck.
