Ambulance Bill

My husband passed away over a year ago and he had an outstanding ambulance bill. His insurance was in his name only. I was not on his insurance. I live in MO. As the surviving spouse and I legally responsible for his bill?

In a word: no.

The ambulance bill belongs to his estate. If there was no estate opened after his death, then the ambulance company cannot collect from you. The only entity they can sue (unless you signed a guaranty agreement agreeing to pay, which I assume you did not), is the estate of your late husband. Under Missouri law, they have only one year in which to petition the court to open an estate and recognize their claim. If they fail to act within that year, then whether they like it or not, their claim is barred forever. If they harass you for payment remind them that they can be sued if they wrongfully sue you.
