I bought a house in a subdivision in April of 2001. I sold it to my mother due to me getting divorced in 2004. I have continued to live, and pay all bills at that residence since. I have been ordered to appear in court due to lack of payment of subdivision dues. When I sold the house to my mom, she never entered into any kind of agreement with the subdivision. Sometimes association dues or fees go the landowner (your Mom),and sometimes they go to the renter or resident.(you) dependig upon the purpose for the fees. If you r mother recorded the deed from you, she shoudl be named in the law suit also. If you failed to take your name off the association rolls and have used any of the amenitites, you may not be able to avoid having to pay the fees. This is somewhat determined by the bylaws of your particular subdivision.
If the subdivision gets a judgment against you and yrou mother, they may be able to garnsih your wages or hers. They may also get lein on tehhosue itself, which woudl have top paid beofre your mother coudl sell or mortgage the property. Depending upon the bylaws of the subdivision they may even be able to foreclose on the property. if you are unable to pay the amount alleged, and you feel it is accurate, you and yrou mother should consult direclty with an attorney in your area before your court date.
