Legal Question in Credit and Debt Law in Missouri
Collection agencies
My husband lost his job which forced us to fall behind on bills, Our long distance service was shut off due to this. Our financial situation is still struggeling. We have not had the money to pay the amount owed which is $100.00.It has been turned over to a collection agency, i have explained our situation telling them i realize i owe the debt and at the time i cannot pay.and will pay as soon as i am able. they call me 2,3,4 times a week, I have asked them not to call instead send me a letter. The woman on the other end says things such as ''I will call you everyday if need be You should have paid your bills'' or '' I will call I have that right while trying to collect a debt'' She is rude and nasty. I ask her for her name and she hangs up on
and does call back the following day, each time i ask for her name she hangs up. After a while I am told that the debt is turned over to a different agency and once again i am having to explain my situation and ask them too not to call instead send letters, once again I recieve the same responce, they call all the time. What can I do?

Re: Collection agencies
Ask politely for their business address. If they want to know why, tell them you need to know where to send money. When they give it to you, send them this short letter:
Dear Sirs:
Consistent with the Fair Debt Collection Practices Act I direct you not to call my house any more. Please correspond with me by mail only.
Sign the letter and send it by certified mail, return receipt requested. If you get calls after that, tell them they are violating the law and that you are going to refer them to the Federal Trade Commission (which is who regulates debt collectors). Usually that will stop them. If it doesn't then contact an attorney or file an action in small claims court against the debt collector.
Best of luck to you.
