Legal Question in Credit and Debt Law in Missouri

collection of continuing debt

I cosigned student loans for my stepson. He is refusing to pay MOHELA and they have comeback to me as cosigner. I have paid 12 months of loans($7,000). He has graduated and is working. What can I do? I have talked with him and sent letters but he won't respond. He is almost 29 and I cosigned for $48000 in loans. I continue paying to avoid legal action from MOHELA.

Re: collection of continuing debt

You can sue him for indemnity and/or unjust enrichment. See a lawyer. You can get a judgment against him and garnish his wages. If he won't honor his committment, and you are being dunned for the obligation, you certainly have a right to ask a court to force him to pay the money.
