Legal Question in Credit and Debt Law in Missouri

Company lied to me

I was found to be in breach of contract for a loan through a private company. I could not attend court and the decision was default due to this. It was decided that my wages were to be garnished. After this the company in question continued to contact me by phone and told me that if I caught up the past due amount the whole matter would be dismissed and I could make monthly payments. I asked if they were aware of the court verdict and they said yes. I spoke to their representative several times and he assured me it would all go away if I caught up the past amount. I had a family member co-sign a loan and paid the past due amount and have since made one monthly payment. When I went in to make the payment in May I spoke to the same representative who said he was sorry but it was too late to stop the garnishment but all money I had paid would go toward the balance. Now I am going to be garnished and I have a loan payment on top. I feel the company maliciously deceived me by stating that everything would be dismissed if I paid the past due. I took their word as truth. Now I have an extreme amount of stress. I did what they told me to do and then was told too bad. Do I have any recourse to resolve this?

Re: Company lied to me

You may have grounds for relief under Chapter 407, RSMO, or under 15 USC 1692. You need to speak with an attorney to see what can be done. This is not a situation where you can act as your own attorney and you need someone to assist you. Legal Aid of Western Missouri may be able to assist you.
