Legal Question in Credit and Debt Law in Missouri

Continual collection phone calls

I had a credit card debt which was written off as a bad debt by the credit card company. It is listed as such on my credit report. My problem is that a collection agency continues to pursue me for payment.

Can I get them to stop their phone calls?

If I do get them to stop calling what options do they have regarding this debt?

Thank you

Re: Continual collection phone calls

Get the name of the collector and the collection agency from the next phone call. Tell them you need their fax number. If they won't give you that information, then get the physical location by saying "if I wanted to send you guys a check, where would I send it." When they give it to you send them a certified letter. That letter says:

Pursuant to the terms of the Fair Debt Collection Practices Act I hereby forbid you to have telephone contact with me. If you contact me again after receipt of this letter, legal action will follow.

Sign it and send it by certified mail, return receipt requested. You won't get any more phone calls. They may still sue you to collect on the debt, but you won't get any more phone calls.
