Legal Question in Credit and Debt Law in Missouri
credit bureau information
An old debt that is well beyond the statute of limitations was sold to a colletion agency. They have now placed this information on my credit report and show the account as being opened in 2006.
This is obviously affecting my credit. Can they take this SOL debt and show it with a new opening date just to get it in my credit report. What options do I have to get this back off my credit report.

Re: credit bureau information
The Fair Credit Reporting Act and the Fair Debt Collection Practices Act govern here. You can get some excellent information from the FTC web site.
Send the collection agency a certified letter, return receipt requested. Dispute the debt. Demand that it be removed from your credit file. Explain it is beyond the statute of limitations, and tell them you will sue them for abuse of process and credit libel if they do not immediately withdraw the false information from your credit report. If they can get you to make even a $1 payment on this account they can restart the statute of limitations. That's what they're aiming for. If you have trouble with them get an attorney involved.
