my son's wife opened a credit card account in his name and forged his signature, he was unaware until the credit card company started calling for collection. His financial situation does not allow him to comply to the arrangement they are asking for, if he is making a payment of any amount on a monthly basis even though it is not the amount they are requesting can they still seek judgement against him?

Many people seem to have the misconception that a creditor can not file suit so long as the person is making regular payments. This is just false. The creditor in your son's case can file a suit to collect money any time they choose to do so. But, your son would have a total defense if he did not sign the application for the card and did not use the card. If the creditor only sued him, then he should hire an attorney and defend the case. I have one of these cases pending at this very moment, and I will win it for the husband I represent. Then the creditor can go after the wife if they choose.
