Legal Question in Credit and Debt Law in Missouri

Credit Card Debt

My spouse has accumulated a large credit card debt in his name only and he is in his late 60's. We have a pre-nuptial agreement but credit card debt was not addressed in it.

When he dies, am I responsible for those debts?

Re: Credit Card Debt

No. But, if he leaves an estate, the creditors can file claims which may be paid out of any assets in the estate. I advise my clients who are in these situations to simply write "Deceased" on any such bills that come after the legally responible partner dies and "Return to Sender". If a collector contacts you in that situation, you may certainly tell them that you are not responsible for the debt and that you'd appreciate no further calls.
