Legal Question in Credit and Debt Law in Missouri
Credit Card Fraud
My brother has the similar situation: Live-in friend used credit cards unbeknownst to him. He does not use the cards...only for emergency and had no debt. Live in friend frauduently added name to a card, began new cards in my brothers name and could still be doing this and having them mailed to her address now. This is reported to 3 credit agencies & credit co. and police depart. reports made-little interest shown. What should my brother do? Would bankruptcy be the best way to rid him of the mess? Would wages be garnished? Will he be arrested? How long will he be pursued? What can happen to the ex-live in doing this? This would be for Missouri. Thank you,

Re: Credit Card Fraud
Your brother needs competent legal help immediately. He has a cause of action against the person who stole his credit card identities and that person may have committed a federal crime. Irrespective of the local police department's relative lack of interest, the Secret Service investigates credit card fraud and could be of assistance.
A private attorney is needed to straighten out the mess. He may need to apply to the Social Security Administration for a new social security number, or take other action to prevent further problems.
If, however, he allowed someone to use his credit cards and they abused the privilege, he is probably indebted to the credit card company. Because there are more questions than answers to provide, I believe a consultation with a competent attorney to be in your brother's best interest.
