Can a non-mortgage debt collector take a tax refund check?

With few exceptions a creditor must have a Judgment against you in order to execute upon that Judgment and intercept a tax refund check. In my experience, the State has been able to do so to collect upon past due child support on occassion. Otherwise, any debt colector threatening you with such is probably violating the Fair Debt Collection Practices Act. I hope that this helps.
