Legal Question in Credit and Debt Law in Missouri

Delinquit Creditor

I had a car reposessed in early 1996, the lender sold the debt to a collector that stopped contacting me for more than 3 years. I was contacted the other day by a different collection agency that said they bought the debt. Am I still obligated after 7 years?

Re: Delinquit Creditor

Yes, probably, but you may have some potential defenses worthy of exploration. Depending on when the contract was signed and the language of the contract, there may be some defenses in the contract. There may also be defenses for impairment of collateral. Your best bet is to obtain an attorney specializing in debtor representation and seek his or her counsel.
