Legal Question in Credit and Debt Law in Missouri

Disposal of credit card debt when disabled

My 76 year old father has suffered a brain stem stroke and has become permanently disabled. We are applying for Medicaid for a permanent placement in a skilled facility. We have discovered that he has about 15,000 in credit card debt. How do we notify the companies that he will no longer be making payments. All of his social security check will be taken by Medicaid.

You probably need to petition the probate court for a guardianship so that you can collect his assets and satisfy the obligations as best you can. The guardianship is the safest way for you to do this. Under no circumstances should you or any other family member personally guarantee the debts.
