Garnishment in Missouri on a Texas Debt

I am currently having my wages garnished for a car that was reposessed in the state of Texas. I borrowed on the car in Texas, and I had it reposessed in Texas. Now, I am living in Missouri, and the credit company sued me. I have lost a judgement against me, so the garnishment is about to begin. Is this legal?

Additionally, the person that I actually purchased the car for, who agreed to make the payments, never did. Can I now sue him for the judgement against me? He still lives in Texas and I feel like I will never get a penny out of him.

Any help you could provide would be appreciated.

It can be nearly impossible to garnish a person's wages in Texas. But, you should get an attorney immediately to determine if you are still within the time allowed to sue the person for whom the car was purchased. You may be able to collect it in a different manner.

An attorney would need to review the court file to be able to advise you whether the judgment against you is valid, but I can tell you that there is nothing wrong with a creditor suing a debtor in the state where the debtor lives. It happens all the time. If it were illegal anyone could run up debts in one state and avoid them by moving to another state. Imagine how much debt you could avoid before you ran out of states to move to. If you want to be certain about your judgment, hire an attorney to check it out. Regarding collecting your losses from the person you bought the car for, you might be able to file suit against that person in Texas, and then garnish his or her wages!
