Legal Question in Credit and Debt Law in Missouri

hospital and doctor bills

We have had alot of financial problems the physician I go to I worked for for 18 years. I recently became sick had surgery after I had aquired insurance. These bills were discussed in the privacy with my doctor and he told me not to worry what ever my insurance did not cover he would have written off and (I have his signed statements that were sent through the billing departmentdr. signed) which is the hospital. They said since they have a contractural agreement with the insurance the doctor has no authority to write these off and the doctor says do noto pay them I told them it was my my businessnad decesion. They are threatening to turn me to collection. Is this not a hippa privacy right between myself and doctor and should not matter to anyone else. Sandy

Re: hospital and doctor bills

The hospital and doctor are different entities, even though they may both provide services at the hospital location. Thus your doctor can write off his part, but the hospital has no obligation to write off their part, and they can and will come after you for the amount you owe.

If the hospital is a "charity" hospital, like one affiliated with a religious order or organized as a "benevolent corporation" then you might want to contact Gray, Ritter and Graham in St. Louis as they are handling a major class action lawsuit on behalf of people who have been charged full (and exhorbitant) prices for care.

Good luck,
