Legal Question in Credit and Debt Law in Missouri

Hugh credit bills by alcoholic

My brother is an alcoholic. He continues to run up big bills on his charge cards. Only his name is on the cards but my sister-in-law feels she is still responsible for paying the bills since they are still married. Is she?

No, not unless she is a co-owner of the credit card account, or perhaps in some circumstances if the credit card was used to pay for the husband's medical expenses. I believe that she can relax.

Normally, only the person who signed the credit card agreement is at issue. However, many credit cards now have statements at the bottom that say "I promise to pay according to the credit card agreement," or words to that effect. If your sister-in-law signed any of the credit card slips (with your brother's authorization) she may be independently liable on those charge card slips (but not for the entire total).

Your brother needs treatment. If your sister-in-law continues to enable his drinking, he won't get it. Alcoholics only respond to "tough love" and it is probably time some was dished out. Left alone, credit card abuse and alcohol abuse are a recipe for serious repercussions.
